(3) Social enterprises are responsible for reinvesting their business income into the enterprise
itself to expand and sustain their operations. It is explicitly prohibited for any associated

enterprise to receive a share of the revenue generated by a social enterprise.
Responsible Agencies
The Minister of Employment and Labor is tasked with formulating a master plan to promote social
enterprises every five years. This master plan must include the overall direction for supporting
social enterprises, as well as the conditions for their promotion and operation. The Minister must
also prepare an annual action plan to implement the objectives of the master plan and conduct
a nationwide survey on the status of social enterprises every five years, reporting the findings to
the Policy Deliberative Council. At the local level, the Mayor of Seoul, other metropolitan mayors,
and provincial governors are responsible for creating and implementing local plans to support
social enterprises. These local plans must align with the national master plan and be reported to
the Minister. The Minister may provide additional support to metropolitan areas or provinces that
present exemplary local plans.
Social Enterprise Registration
Organizations wishing to operate as a social enterprise must register and obtain certification from
the Minister of Employment and Labor. They must meet the following qualifications:
1. The organization must take a legal form as prescribed by Presidential Decree, such as a legal
entity or association under the Civil Act, a corporation or limited partnership under the
Commercial Act, a legal entity under other special laws, or a non-profit private organization.
2. It must employ paid workers and conduct business activities such as producing and selling
goods or providing services.
3. Its primary goal must be a social objective, for example, improving the quality of life for
community members by providing social services to vulnerable groups, creating employment
opportunities, or generating other community benefits. Specifics are to be prescribed by
Presidential Decree.
4. The organization must have a decision-making structure that allows stakeholder participation,
such as involving service beneficiaries and employees.
5. Its business income must comply with standards set by Presidential Decree.
6. The organization's bylaws must state its name, objectives, business scope, location,
organizational structure, management system, work processes, decision-making procedures
for key matters, profit management and reinvestment into the organization, capital and loans,
employee composition, hiring and dismissal processes, and asset management upon
